Spell check doesn't seem to work properly. I have "Check spelling as you type" selected, but when I right-click on an error, the spelling doesn't appear in the contextual menu.

I've seen the same behavior: mistakes are underlined, but there is no list of possible corrections in the centext menu (and I make a lot of errors when I type!).

It works for me... In the ctrl-click menu, you need to go to Spelling > Spelling... Or, place the cursor inside the word and click Option-Escape to get a list of all suggestions. This behaviour is new in Tiger, I believe (Scrivener just uses custom OS X behaviour for spell-checking).

I'm referring to the suggested spellings that appear at the top of the contextual menu when you ctrl-click in any other application. Also, sometimes when I switch between documents and ctrl-click, nothing happens. If I then highlight some text, I can get a contextual menu.

Scrivener works exactly the same as TextEdit, Ulysses, CopyWrite etc in this regard. I don't know about the ctrl-click thing - it's probably just because the text view needs focus (though I haven't experienced this).

Somewhere we are talking at cross-purposes.
In both TextEdit and Scrivener (and many others):
- To turn on "Check Spelling as You Type" you can either choose "Edit-Spelling-Check Spelling as You Type" or right-click (or ctrl-click) in a text window to show the contextual menu and choose "Spelling-Check Spelling as You Type".
- To correct spelling in Textedit, Safari, etc., if you right-click (or ctrl-click) on a misspelled word, you additionally get a list of possible corrections plus Ignore Spelling and Learn Spelling menu items. e.g., right-click on "brobwn" and you are offered "brown" as the correct spelling.
Scrivener doesn't (currently) do this (although it does let you check spelling by opening the Spelling... dialog box).
(The Option-Escape to popup a word list is new to me, but what it does is offer word completion: if you type "walk" and, with the cursor after the k press option-escape, you will get a list of possible words beginning with "walk".)

Just to pipe in another voice that I use this feature in most other programs with a two-button mouse. By right clicking (although control-clicking works fine) the suggested words populate the top of the contextual menu.
Nearly all programs that have text-editing capabilities have this--Mail for instance. Even Safari, in this text field I am typing in now, with 'check spelling as you type' selected, if I misspell a word (sadly quite often) it allows me to quickly address it this way. If the a suggestion doesn't appear, a grayed out "No Guesses Found" appears.

Okay, I see it now. Will look into it. Shouldn't be a toughie. Thanks, KB
